1 About this website
This website is operated by Agave Resources Australia Pty Ltd (ACN 661 946 872), trading as Agave Resources (“ARA”, “we”, “us” or “our”). These terms explain the permitted use of our website and the basis on which its information is provided. Please read them before using the website. Contact us at info@agaveresources.com if you have questions.
Purchases are also subject to the Shop Terms and Shipping & Returns policy presented before purchase. Paid programs, plant supply, professional services and investment transactions may have separate written agreements. Those agreements govern their subject matter; these website terms do not change rights under an existing agreement.
2 General information
Website material is provided for general information. It does not take into account your property, operations, financial circumstances or particular objectives, and is not a substitute for site-specific agronomic, animal nutrition, engineering, environmental, legal, taxation or investment advice. Seek appropriately qualified advice before making decisions that require it.
3 Research and crop performance
Agave species and varieties differ, and performance depends on factors including site, soils, rainfall, temperature, plant material, establishment and management. Examples, photographs, illustrations and trial results must be read in their stated context. Results from one site or trial do not guarantee results elsewhere. Illustrations may be indicative and are not planting designs or specifications.
Descriptions of fuel pathways, livestock applications, carbon outcomes and other products may refer to research, modelling or opportunities under development. Technical feasibility, commercial viability, approvals and lifecycle emissions depend on the particular project and supporting evidence. Website descriptions are not guarantees of yield, suitability, carbon credits or commercial performance.
4 Grower and commercial opportunities
Descriptions of AgaveLink™ benefits, plant releases, services and market opportunities indicate the program’s intended direction and current offering as stated. Availability, eligibility, timing, prices and any commitments will be set out in the relevant offer or agreement. Registering interest does not create membership, reserve plants, establish supply obligations or guarantee offtake.
5 Investment information
General company information on this website is not an offer to issue or sell securities, a recommendation to invest, or personal financial advice. Any investment opportunity is subject to its own approved documents, eligibility requirements and applicable law. Forecasts, targets and development plans involve uncertainty and may change. There is no guarantee of funding, completion, commercial outcomes or investment returns.
6 Restricted investor access
Access to the investor area is limited to users authorised by ARA. Existing shareholders and prospective investors may have different permissions. Prospective investor access may require an executed NDA and further approval. Login access does not itself create or replace an NDA or confirm eligibility to invest.
Use only your own account, keep credentials secure, and access only the material made available to you. Do not share restricted documents or upload them to public services or third-party AI tools except as allowed by the applicable NDA, document terms or ARA’s written permission. Notify us promptly if you suspect unauthorised access. Shareholder rights to information under law or an agreement are not limited by website permissions.
We may reasonably suspend access to address a suspected security incident, unauthorised sharing or a material breach of these access conditions. Where practicable, we will explain the concern and give you an opportunity to respond. Any paid service or other contractual rights remain governed by its separate agreement.
7 Website content and intellectual property
Rights in website text, research materials, photographs, illustrations, graphics, logos and other content belong to ARA or the relevant rights holders, to the extent those rights exist. You may view public content and make reasonable copies for personal reference or internal evaluation, keeping attribution and notices intact. This permission does not authorise republication, merchandising, commercial redistribution or use of our branding without permission, except as permitted by law.
Please contact us about media use or other permissions. Third-party names and logos remain the property of their owners. Their appearance does not imply endorsement beyond any relationship expressly described.
8 Appropriate use and external services
Do not use the website unlawfully, impersonate another person, submit malicious material, interfere with its operation or attempt to bypass access controls. Provide accurate information where needed to process an enquiry or transaction. Our Privacy Policy explains how we handle personal information. External websites and services have their own terms; we do not control their content or practices.
9 Accuracy availability and responsibility
We take reasonable care with website information but cannot promise that every page is complete, current or free from error, or that the website will always be available. Please contact us to confirm information material to your decision. We may correct public information or interrupt access for maintenance and security. Corrections do not retrospectively change an accepted order or separate agreement.
Nothing in these terms excludes, restricts or modifies a consumer guarantee, statutory right or liability that cannot lawfully be excluded. We do not seek to exclude responsibility for our fraud, deliberate misconduct or failure to meet an obligation that applies by law. Any additional liability arrangements for a paid service or transaction must be set out in its separate agreement.
10 Changes and applicable law
We may update these terms for future website use and will show the revision date. Material changes to restricted access conditions will be notified to affected users before taking effect where practicable, except where urgent action is reasonably needed for security or law. These terms are governed by Queensland law. Courts of Queensland have non-exclusive jurisdiction, subject to any mandatory rights you have to bring proceedings elsewhere. If a provision cannot be enforced, the remaining provisions continue to the extent legally possible.
